In the event you have been charged with a DUI in the State of Arizona, the officer may have confiscated your driver’s license and served you with a license suspension form called an ‘Admin Per Se’, which is an MVD action that takes place 30 days after the affidavit is served to the driver. This form will serve as your temporary driver’s license during that 30-day period. The driver will have 30 days from the date of service (which is usually the same day as the DUI arrest) to request a hearing with the Motor Vehicle Division (MVD) – Executive Hearing Office. If a hearing is requested, there may be a stay (delay) on the license suspension until the date of the hearing at the Executive Hearing Office. If you fail to request this hearing within the 30-day limit, you could face an automatic license suspension for 90 days. If a hearing is scheduled, an MVD Administrative Law Judge will review your case and decide whether you will be able to maintain your driving privileges. During this hearing, proof of your intoxication must be presented by law enforcement testimony, the results of breath and blood alcohol tests, or the results of the sobriety test that was administered at the time of the DUI stop.
