While all DUI cases are taken seriously, a first time offender is more likely to receive a reduction of charges or a reduced sentence than one who has already had multiple DUI convictions.

Additional Information About Aggravated DUI

While aggravated DUI is a felony charge which applies to offenders who have had two prior DUI convictions within the last seven years, what about individuals who have had one prior DUI conviction within the last seven years? Or an individual who has had two or more past DUI convictions, but not within the last seven years?

To answer the second question, if you are convicted of a second DUI but 7 years after your first, this falls outside of the 7 year window, which means that this will be treated as a first-time conviction again. If, however, you are convicted of another DUI within the 7 year window of your first DUI, you will face enhanced penalties- you are now known as a repeat offender.

Penalties for Repeat DUI Offenders in Arizona

In Arizona, it is a Class 1 misdemeanor if you are convicted of a second offense of DUI. You will most likely face a 90 day sentence in jail and the first 30 days must be served. If you complete alcohol/drug treatment, 60 days of your sentence can be suspended.

    • You could pay upwards of $3,500 in fines. Other penalties you will face include the following:
    • 1 year license suspension
    • Your probation can last up to 5 years (10 years for an aggravated DUI conviction)
    • Alcohol screening and classes
    • Installment of an ignition interlock device
    • Community work service
What About a Subsequent Extreme DUI or Super Extreme DUI Charge?

In Arizona, if you are convicted of a Second Extreme DUI, you will be facing the following penalties:

    • A revocation of driving privileges for one year
    • Probation for up to 5 years
    • A minimum of 120 days in jail (mandatory 60 consecutive days in jail)
    • $4,000 in fines

If you are convicted of a Second Super Extreme DUI, you will be facing the following penalties:

    • Revocation of driving privileges for one year
    • Probation for up to 5 years
    • 180 days in jail (with 90 consecutive days mandatory)
    • $5,000 or more in fines

DUI's have an accumulating nature-the more DUI's you receive, the more harsh the consequences. This is especially true in the case of an Extreme DUI or Super Extreme DUI. For example, a second regular DUI charge comes with 29 more days in jail then a first offense. A second extreme DUI charge comes with 4 months in jail and a second super extreme charge comes with six months. Since you are now considered a repeat offender, prosecutors will fight harder to take away your freedom to drive and to increase your penalties.
